Foundations · Lesson 1 · About 8 minutesWho promises to pay?

Learning goal: Distinguish advice, nomination and confirmation before deciding who owes payment.

Begin with the credit itself: identify the applicant, beneficiary, issuing bank, availability and incorporated rules. UCP 600 applies through express incorporation. Its provisions can be modified or excluded by the credit, so a rule remembered in isolation is not enough.

The issuer gives the credit undertaking. A confirming bank adds its own undertaking when it actually adds confirmation. An advising bank checks apparent authenticity and accurately conveys the credit; advice alone does not create an undertaking to pay. Nomination authorizes a bank to act but does not by itself require a non-confirming nominated bank to honour or negotiate.

Honour covers sight payment, deferred payment and acceptance according to the availability. Negotiation means purchase through advancing or agreeing to advance funds under a complying presentation; merely checking and forwarding documents is not negotiation.

Advising, nomination ও confirmation এক নয়। প্রথমে নির্ধারণ করুন কোন ব্যাংক payment undertaking দিয়েছে।

Worked example

An LC names Bank B as nominated bank. Bank B advises it without confirmation and only forwards documents. The beneficiary calls this negotiation.

  1. Find whether Bank B added confirmation or separately agreed to act. Neither is stated here.
  2. Look for purchase or an agreement to advance funds. Forwarding alone supplies neither.
  3. Conclusion: Bank B has not negotiated merely by forwarding; the issuer’s undertaking remains separate.

Common mistake: A bank appearing in the LC is not automatically a confirming bank.

Foundations · Lesson 2 · About 7 minutesDocuments, goods and the sales contract

Learning goal: Explain why a commercial complaint is different from a documentary discrepancy.

The sales contract and the credit are separate transactions. A bank tests the presentation against the credit, applicable UCP provisions and international standard banking practice. It does not inspect the goods to establish documentary compliance.

This separation protects a beneficiary from an applicant withholding credit payment solely because of a sales dispute. It also means a compliant document set is not a guarantee of goods quality. Fraud, sanctions and mandatory law require their own controls; documentary autonomy is not permission to ignore them.

Build a discrepancy around a stated credit requirement and the relevant document data. An applicant’s complaint or a different commercial expectation is not, by itself, that evidence.

পণ্যের বিরোধ আর documents-এর discrepancy আলাদা। LC-র শর্ত ও উপস্থাপিত documents মিলিয়ে সিদ্ধান্ত নিতে হবে।

Worked example

The applicant emails that a machine is faulty. The stipulated inspection certificate and other documents comply on their face. No court order, fraud finding or sanctions issue is assumed.

  1. Record the goods complaint separately from the document examination.
  2. Identify any actual failure in the stipulated documents; none is stated.
  3. Conclusion: the complaint alone is not a documentary ground for refusal. Escalate any separate legal issue through the appropriate process.

Common mistake: Do not convert a buyer’s dissatisfaction into an invented discrepancy.

Foundations · Lesson 3 · About 8 minutesRead date words precisely

Learning goal: Separate shipment, presentation and expiry deadlines.

Latest shipment controls shipment timing. A presentation period controls how long after shipment the relevant documents may be presented. Expiry is another limit at the required place. Passing one test does not excuse failing another.

Under Article 3, shipment “on or about” a date permits the five calendar days before and after that date, with both boundaries included. “To”, “until”, “till”, “from” and “between” used for a shipment period include the stated dates; “before” and “after” exclude them. For a maturity date, “from” and “after” exclude the stated date. Read the context before counting.

Article 29 may extend expiry or the last day for presentation when the bank is closed for a reason other than Article 36. It does not extend the latest shipment date. A bank need not accept presentation outside its banking hours.

Shipment date, presentation period ও expiry আলাদা সীমা। একটি ঠিক থাকলেই অন্যটি ঠিক হয়ে যায় না।

Worked example

The credit calls for shipment on or about 15 June. The bill of lading shows shipment on 21 June.

  1. The permitted shipment window is 10–20 June inclusive.
  2. 21 June is outside that window.
  3. Conclusion: shipment is late under this condition, even if documents reach the bank before expiry.

Common mistake: Never count banking days where the rule calls for calendar days.

Foundations · Lesson 4 · About 7 minutesWhich amendment is effective?

Learning goal: Build one effective set of credit terms before examining documents.

The issuing bank is bound when it issues an amendment. For the beneficiary, the existing terms remain in force until acceptance is communicated, or a qualifying presentation establishes acceptance under Article 10(c). These are different points in time.

A beneficiary cannot take the favourable part of one amendment and reject the unfavourable part. Partial acceptance is treated as rejection. A clause saying an amendment automatically becomes effective unless rejected within a specified period is disregarded.

Confirmation must be checked separately: a confirming bank may advise an amendment without extending confirmation, provided it makes the required notifications. Maintain an amendment register showing acceptance and confirmation status, not only the message receipt date.

এক amendment-এর সুবিধাজনক অংশ গ্রহণ করে বাকি অংশ বাদ দেওয়া যায় না। Beneficiary acceptance ও confirmation আলাদাভাবে দেখুন।

Worked example

One amendment increases the amount and shortens the latest shipment date. The beneficiary accepts only the amount increase.

  1. Both changes belong to one amendment.
  2. The response attempts partial acceptance.
  3. Conclusion: do not construct a hybrid LC; Article 10(e) treats that response as rejection of the amendment.

Common mistake: Receipt of an amendment does not by itself establish beneficiary acceptance.

Examination · Lesson 5 · About 10 minutesControl the examination clock

Learning goal: Calculate presentation and examination limits without mixing the two.

Each relevant bank has a maximum of five banking days following the day of presentation to determine compliance. The presentation day is not day one. Count the banking days at the place where the relevant act is performed, using that bank’s actual operating calendar.

For presentations containing original transport documents covered by Articles 19–25, the default is presentation within 21 calendar days after shipment and no later than expiry, unless the credit modifies the rule. This is a presenter’s deadline, not the bank’s examination period.

A timely presentation is not deprived of its examination period because expiry occurs during examination. Conversely, five banking days for examination do not cure a presentation made after the permissible deadline.

২১ calendar days হলো presentation-এর সীমা; পাঁচ banking days হলো bank examination-এর সময়। দুটো এক নয়।

Worked example

Documents are presented on Monday. For this hypothetical bank, Monday–Friday are banking days and there are no holidays. The credit expires on Tuesday.

  1. Exclude presentation Monday. Tuesday, Wednesday, Thursday and Friday are days 1–4.
  2. The next Monday is day 5.
  3. Conclusion: Tuesday’s expiry does not shorten examination of this timely presentation; any refusal must satisfy the deadline and notice requirements.

Common mistake: Do not assume every bank has the same weekend or holiday calendar.

Examination · Lesson 6 · About 8 minutesDifference or genuine conflict?

Learning goal: Apply document-specific tests instead of demanding identical wording.

Article 14(d) requires contextual consistency, not identical data everywhere. An abbreviation, a general description or a different layout is not automatically a discrepancy. Identify what the difference means before deciding.

The invoice has its own description requirement: it must correspond with the credit. Other stipulated documents may use a general goods description that does not conflict. This is why a packing list and invoice should not be examined under an identical description test.

Under Article 14(j), applicant and beneficiary addresses generally need to remain in the respective countries stated in the credit. The transport-document consignee or notify-party exception requires the applicant’s address and contact details to be as stated. Read the exception before dismissing a difference.

শব্দে শব্দে এক হওয়া জরুরি নয়; তথ্য পরস্পর বিরোধী কি না এবং document-specific rule কী—সেটিই মূল পরীক্ষা।

Worked example

The credit and invoice describe “Model AX-200 industrial pump”. The packing list says “industrial pump”, with no conflicting model elsewhere.

  1. Apply Article 18 to the invoice: its model description corresponds.
  2. Apply Article 14(e) to the packing list: its general description does not conflict.
  3. Conclusion: the shorter packing-list description is not by itself a discrepancy. A different model number would require a different conclusion.

Common mistake: A short description and an inconsistent description are not the same thing.

Documents · Lesson 7 · About 8 minutesExamine the commercial invoice

Learning goal: Check issuer, addressee, currency, description and drawing amount.

Ordinarily the invoice must appear issued by the beneficiary, be made out to the applicant and use the credit currency. Article 38 supplies exceptions for transferred credits. An invoice does not need a signature under UCP alone, but an express signed-invoice requirement must still be met.

An invoice amount above the permitted credit amount is not the same as an excessive drawing. Article 18(b) permits a relevant bank to accept an excess-value invoice provided honour or negotiation does not exceed what the credit permits. That is discretion, not an automatic obligation.

Compare goods descriptions, quantity, unit price and permitted tolerances together. Do not check the total in isolation or assume a quantity tolerance also increases the amount available.

Invoice value ও amount drawn আলাদা। UCP-তে signature না লাগলেও LC-তে signed invoice চাইলে তা মানতে হবে।

Worked example

An LC for USD 50,000 calls for a commercial invoice, without a signature condition. An unsigned beneficiary invoice for USD 50,000 otherwise complies.

  1. Confirm the credit contains no separate signature requirement.
  2. Apply Article 18(a)(iv): signature is not required by UCP alone.
  3. Conclusion: unsigned status alone is not a discrepancy; continue the other checks.

Common mistake: A bank’s usual checklist must not add a document requirement the LC and applicable rules do not impose.

Documents · Lesson 8 · About 10 minutesRead an ocean bill of lading

Learning goal: Identify signature capacity, shipment date and routing from actual document data.

Start by selecting the correct transport article. An ocean bill of lading under Article 20 must identify the carrier and show a permitted signature capacity. An agent’s signature must make clear whether it is for the carrier or master. The issuer’s business name alone does not establish that capacity.

A forwarder may issue a transport document if it meets the applicable article. A blanket assumption that all forwarder bills are acceptable—or all are unacceptable—misses the test. Credit wording may also impose a specific restriction.

A dated on-board notation can determine shipment date even when the issue date differs. Check the actual vessel, required ports, full set of originals, carriage terms and absence of charter-party indication. Cleanliness concerns clauses expressly declaring defective goods or packaging, not whether the word “clean” is printed.

Forwarder-এর নাম দেখে সিদ্ধান্ত নয়। Carrier, signature capacity, on-board date, ports ও originals পরীক্ষা করুন।

Worked example

An otherwise compliant bill identifies Ocean Carrier Ltd and is signed “Harbour Logistics, as agent for Ocean Carrier Ltd, carrier”. It has a dated on-board notation.

  1. The named carrier is identified.
  2. The signature identifies agency for that carrier; forwarder status alone does not defeat that signature.
  3. Conclusion: this signature element can satisfy Article 20. Check remaining document and credit requirements before concluding on the whole presentation.

Common mistake: Passing the signature test does not prove the entire bill or presentation complies.

Documents · Lesson 9 · About 9 minutesTest insurance timing and amount

Learning goal: Calculate required cover and distinguish issue date from effective cover.

An insurance document must appear issued and signed in a permitted insurance capacity. Identify the insurer or underwriter and, where relevant, the signing agent’s capacity. Present all originals when more than one is indicated. A cover note does not satisfy Article 28.

The insurance document should be dated no later than shipment unless it evidences cover effective no later than shipment. Therefore a later issue date is not automatically fatal: read the effective-cover evidence.

Apply the credit’s coverage requirement. If the credit gives no coverage amount, Article 28 uses at least 110% of CIF or CIP value. If that value cannot be established from the documents, apply the rule’s alternative base. Cover must use the credit currency and extend over the required route; an adequate amount alone is insufficient.

Issue date পরে হলেই insurance discrepant নয়—shipment date থেকে cover কার্যকর ছিল কি না দেখুন।

Worked example

The credit requires insurance for 110% of a USD 80,000 CIF invoice. Shipment is 8 June. A certificate issued on 10 June states cover effective 8 June and provides USD 88,000.

  1. Calculate 80,000 × 1.10 = USD 88,000.
  2. The stated effective cover begins on shipment day despite later issuance.
  3. Conclusion: amount and timing pass the stated tests. Still examine issuer/signature, route, risks and originals.

Common mistake: “All risks” does not mean the policy contains no exclusions.

Lesson link
Examination · Lesson 10 · About 10 minutesWrite a defensible refusal

Learning goal: Turn findings into a complete and timely notice.

A discrepancy log is not itself a refusal notice. When refusing, the relevant bank must send the presenter one notice containing the refusal, each discrepancy relied upon and a permitted statement of what it is doing with the documents.

Make each finding specific enough to be understood: identify the document data and the requirement it fails. Avoid phrases such as “documents not in order” with no explanation. Select a document-disposition statement that matches the actual handling.

An issuing bank may approach the applicant for waiver, but that does not extend the deadline. Applicant waiver is not automatic acceptance by the bank. Failure by the issuing or confirming bank to comply with Article 16 can preclude it from claiming the presentation is non-complying.

Waiver চাইলে refusal clock থামে না। Notice-এ refusal, সব discrepancy ও documents-এর disposition থাকতে হবে।

Worked example

The latest shipment date is 10 June but the B/L shows 12 June. The bank plans to refuse and hold documents pending presenter instructions.

  1. State that the bank refuses to honour or negotiate, as relevant.
  2. Identify late shipment precisely: B/L shipment 12 June against LC latest shipment 10 June; include every other established discrepancy.
  3. State that documents are held pending further presenter instructions and send within Article 16’s deadline.

Common mistake: Never assume the applicant’s waiver cures a late or incomplete refusal notice.

Lesson link
Advanced application · Lesson 11 · About 9 minutes“About” applies to what?

Learning goal: Keep amount, quantity and unit-price tolerances separate.

Article 30(a) gives a 10% margin above or below the amount, quantity or unit price to which “about” or “approximately” refers. First locate the word. A quantity tolerance does not automatically become an amount tolerance.

Read express tolerance provisions and exclusions before applying the default rules. Check whether the permitted quantity and unit price can be funded within the available credit amount. A mathematically permitted quantity can still produce an excessive drawing.

Use a small three-column worksheet: quantity range, unit-price range and amount cap. This makes mismatched LC terms visible before documents arrive.

“About” যে amount, quantity বা unit price-এর সঙ্গে আছে, tolerance সেই অংশে প্রযোজ্য। সব ক্ষেত্রে একসঙ্গে নয়।

Worked example

The LC permits “about 200 MT” at USD 250 per MT but caps the amount at USD 50,000 with no amount tolerance. Shipment is 220 MT at the stated unit price.

  1. The quantity range is 180–220 MT under Article 30(a).
  2. 220 × USD 250 = USD 55,000, exceeding the USD 50,000 cap.
  3. Conclusion: quantity falls within its range, but a USD 55,000 drawing is not permitted by these terms.

Common mistake: Do not silently add 10% to the credit amount because quantity says “about”.

Teaching slides · Article 30

Lesson link
Advanced application · Lesson 12 · About 9 minutesBulk quantity versus packing units

Learning goal: Apply the conditional 5% quantity tolerance and respect the amount cap.

Article 30(b) permits a quantity variation up to 5% where the credit does not state a stipulated number of packing units or individual items, and total drawings stay within the credit amount. Express credit terms may change this.

Weight or volume quantities such as MT can fall within this rule. A stipulated number of bags, cartons or individual machines does not acquire this automatic 5% tolerance. Read how the quantity is actually expressed rather than classifying only by the commodity name.

Keep Article 30(c)’s conditional amount shortfall separate from Article 30(b)’s quantity margin. Do not use either as a blanket permission to change an expressly stated unit price or ignore a no-variation clause.

২০০ MT আর ২০০ bags এক ধরনের quantity expression নয়। ৫% quantity tolerance স্বয়ংক্রিয়ভাবে packing units-এ প্রযোজ্য নয়।

Worked example

The LC specifies 200 MT at USD 250 per MT, USD 50,000 maximum, no express tolerance and no partial shipments. The invoice is for 196 MT at USD 250, total USD 49,000.

  1. The Article 30(b) quantity range is 190–210 MT. 196 MT falls inside.
  2. The unit price is unchanged and USD 49,000 stays below the cap; the drawing is also only 2% below the credit amount.
  3. Conclusion: these quantity and amount facts do not establish a tolerance discrepancy. Replacing “200 MT” with “200 bags” would change the quantity test.

Common mistake: 5% more quantity does not authorize 5% more money.

Lesson link
Advanced application · Lesson 13 · About 8 minutesPartial shipments and missed instalments

Learning goal: Distinguish conveyance tests from a time-bound instalment schedule.

Partial shipments and drawings are allowed unless the credit changes that position. Multiple transport-document sets do not necessarily mean a partial shipment: Article 31 examines conveyance, journey and destination.

Sets evidencing the same means of conveyance, same journey and same destination can avoid partial-shipment classification even with different shipment dates or loading points. For such a presentation, use the latest evidenced shipment date. Different conveyances within the same transport mode constitute partial shipment even if they depart the same day for the same destination.

Article 32 concerns stipulated instalments within given periods. Missing one instalment causes the credit to cease to be available for that and later instalments under that rule. Do not treat a later catch-up shipment as automatically restoring availability.

দুটি B/L মানেই partial shipment নয়। আর নির্দিষ্ট period-এর instalment মিস হলে পরের instalment-ও প্রভাবিত হতে পারে।

Worked example

A credit requires one shipment in June and another in July. No June shipment occurs. The beneficiary proposes shipping both quantities in July.

  1. The LC stipulates instalments within given periods, so Article 32 is relevant.
  2. The June instalment was missed.
  3. Conclusion: the credit ceases to be available for June and July under that rule; a July catch-up alone does not fix it. An effective amendment would need separate consideration.

Common mistake: Do not apply instalment consequences merely because an LC allows ordinary partial shipments.

Advanced application · Lesson 14 · About 10 minutesTransfer the credit, preserve the conditions

Learning goal: Identify what a transferring bank may change and who presents.

The credit must expressly state that it is transferable. Even then, the bank transfers only to the extent and in the manner it consents to. A transfer request comes from the first beneficiary; it does not create an unrestricted right to demand any form of transfer.

The transferred credit generally mirrors the original, including confirmation if any. Article 38 permits specified reductions or curtailments, including amount, unit price and certain deadlines. The insurance percentage may be increased to preserve the required monetary cover. This is not a general power to rewrite documents, goods or routing.

The first beneficiary may substitute its invoice and draft, if any, within the rules. It does not obtain a general right to substitute every document. A second beneficiary presents to the transferring bank; it cannot request an onward transfer to a subsequent beneficiary.

Transferable লেখা থাকলেও bank consent লাগে। Invoice substitution-এর অধিকার মানে সব document বদলানোর অধিকার নয়।

Worked example

The original LC amount is USD 100,000 and insurance required is USD 110,000. A transfer for USD 80,000 needs the same monetary insurance cover.

  1. Calculate 110,000 ÷ 80,000 × 100 = 137.5%.
  2. Article 38(g) allows an increased insurance percentage to preserve cover.
  3. Conclusion: 110% of the reduced USD 80,000 amount would provide only USD 88,000; align the transfer terms with the required USD 110,000.

Common mistake: Transfer is not a new independent back-to-back LC.

Rule reference: UCP 600 Articles 38 · Google Drive PDF reference

Teaching slides · Article 38

Lesson link
Advanced application · Lesson 15 · About 7 minutesAssignment is not transfer

Learning goal: Separate entitlement to proceeds from the right to perform under the credit.

Article 39 recognizes that a beneficiary may assign proceeds it is or may become entitled to receive, subject to applicable law, even if the LC is not transferable. The assignee’s interest is in proceeds; this does not make it a second beneficiary entitled to perform under the LC.

Article 38 transfer makes credit availability accessible to a second beneficiary through the prescribed transfer process. Assignment does not replicate that process. Read the assignment document and applicable law separately rather than promising payment merely because an assignment notice exists.

The original beneficiary still needs to establish entitlement under the credit. Assignment does not make discrepant documents compliant or create proceeds where no entitlement arises.

Proceeds assignment হলো পাওনা অর্থের অধিকার হস্তান্তর; LC-তে performance বা presentation-এর অধিকার transfer নয়।

Worked example

A non-transferable LC beneficiary assigns proceeds to its lender. The lender asks to replace the beneficiary and ship goods under the LC.

  1. The stated arrangement assigns proceeds under Article 39.
  2. It does not transfer the right to perform or make the lender a second beneficiary.
  3. Conclusion: the lender cannot rely on that assignment alone to take over performance under the credit.

Common mistake: An assignment acknowledgement should not be described as an unconditional payment guarantee.

Advanced application · Lesson 16 · About 9 minutesClosure, lost documents and risk allocation

Learning goal: Avoid treating all interruptions as an automatic deadline extension.

Routine non-banking closure and an Article 36 interruption are different. Article 29’s next-banking-day extension excludes the Article 36 situation and never extends latest shipment. Article 33 separately addresses presentation outside banking hours.

Article 35 contains an important lost-document protection: when the nominated bank determines compliance and forwards documents, the issuer or confirmer must honour or negotiate, or reimburse that nominated bank, even if documents are lost in transit between the specified banks. This is not a blanket rule for every lost package.

Articles 34 and 37 allocate specified document and instructed-party risks. They do not remove the need to examine documents properly or follow mandatory law. Identify the relevant bank, event and conditions before citing a disclaimer.

সাধারণ bank closure আর force majeure এক নয়। Lost documents-এর ক্ষেত্রেও কোন bank compliance নির্ধারণ করে পাঠিয়েছে তা জরুরি।

Worked example

A nominated bank determines that a presentation complies and forwards the documents to the issuing bank. They are lost during that bank-to-bank transit.

  1. The scenario meets the compliance-determination and forwarding conditions described in Article 35.
  2. Loss occurs in the specified bank-to-bank transit.
  3. Conclusion: physical loss alone does not release the issuing bank from the Article 35 obligation. Preserve the examination and dispatch evidence.

Identify applicant, beneficiary, issuing bank, advising bank and any confirming or nominated bank. Separate the sales dispute from the bank’s documentary undertaking. Read availability, expiry, place of presentation and amendment history before examining individual documents.

2. Examine the presentation

Build a credit-specific checklist. Review documents together for conflicts rather than demanding identical wording everywhere. Distinguish latest shipment, expiry and any presentation period. Count the examination period in banking days under the applicable rule; it is not an automatic extension of expiry.

3. Decide and communicate

Record each genuine discrepancy and its credit or rule basis. A refusal must meet the applicable notice requirements; seeking an applicant waiver does not suspend the deadline. Keep document disposition instructions clear.

Worked Case

Scenario: A buyer complains that goods are defective, but the documents appear compliant. Should the examiner reject solely on that complaint?

Approach: Separate goods performance from documentary compliance. Examine the presentation under the credit and applicable rules; escalate any distinct fraud, sanctions or legal issue through the bank’s controls.

Self-Check And Answer

Does an applicant’s waiver automatically compel the issuing bank to accept?

Show Answer

No. The issuing bank must make its own decision and meet the applicable examination and notice requirements.

2. ISBP 821 — Document Examination Practice

ISBP 821 (2023), read with UCP 600

1. Use the correct document section

Start with the credit and UCP, then consult the ISBP practice for the actual document: invoice, transport, insurance, origin or another certificate. ISBP explains examination practice; it does not replace the credit.

2. Check substance and consistency

Compare names, goods, dates, amounts, routing and document function. Treat an apparent spelling variation differently from a change of party or goods identity. Record why data conflict, rather than simply marking every difference as a discrepancy.

3. Keep an examination trail

For each concern, capture the credit requirement, document wording, applicable practice and conclusion. Separate a request for clarification from an established discrepancy.

Worked Case

Scenario: An invoice and packing list describe the same goods at different levels of detail. Is a discrepancy automatic?

Approach: No. Check the credit’s specific requirements and whether the descriptions conflict. Apply the relevant document-specific practice; detail alone is not the decision.

Self-Check And Answer

Should the same checklist be used unchanged for an air waybill and an ocean bill of lading?

Show Answer

No. Select the applicable transport-document rules and practices, then test that document’s required content.

3. Incoterms® 2020 — Delivery, Cost and Risk

11 Incoterms® 2020 rules

1. Choose by transport and delivery

Any-mode rules: EXW, FCA, CPT, CIP, DAP, DPU and DDP. Sea/inland-waterway rules: FAS, FOB, CFR and CIF. Write the precise named place or port and the edition into the sale contract.

2. Separate cost from risk

A seller paying carriage does not necessarily bear transit risk until arrival. Identify the delivery point first, then allocate carriage, insurance, clearance and unloading. Incoterms do not themselves determine payment method or transfer of ownership.

3. Align documents with the transaction

Check the transport route and insurance requirement against the chosen term and the credit. CIF and CIP have different default insurance levels. FCA permits an agreed arrangement for an on-board bill of lading.

Worked Case

Scenario: A CFR sale suffers transit damage after loading on board. Does the seller’s payment of freight alone mean the seller retained the transit risk?

Approach: No. Cost payment and risk transfer are separate. Identify contractual delivery under CFR, then consider insurance, breach and the governing law.

Self-Check And Answer

Which rule explicitly includes unloading at the named destination: DAP or DPU?

Show Answer

DPU. Under DAP, delivery is on the arriving means of transport ready for unloading.

4. URC 522 — Documentary Collections

URC 522; collection instruction and release terms

1. Trace the collection

Map principal, remitting bank, collecting bank, presenting bank and drawee. Read the collection instruction, currency, charges and document-release conditions. A collection is not the same bank payment undertaking as a documentary credit.

2. Distinguish D/P and D/A

Under documents against payment, release follows the specified payment condition. Under documents against acceptance, release follows the specified acceptance condition; acceptance alone does not ensure payment at maturity. Identify who bears buyer and country risk.

3. Handle exceptions

Check instructions for non-payment, non-acceptance, protest, charges, storage and a case-of-need contact. Escalate unclear instructions before release. Do not silently turn D/P into D/A.

Worked Case

Scenario: The buyer asks for shipping documents now and promises payment next week under a D/P instruction. Can the presenting bank release on that promise?

Approach: Follow the collection instruction. Obtain an authorized change through the proper channel before changing the release condition.

Self-Check And Answer

Does a collecting bank ordinarily examine collection documents for LC-style compliance?

Show Answer

No. Collection handling and the relevant document checks differ from examination under a documentary credit.

5. URR 725 — Bank-to-Bank Reimbursement

URR 725 and the reimbursement authorization

1. Map the funding channel

Identify issuing, claiming and reimbursing banks. Distinguish a reimbursement authorization from a reimbursement undertaking.

2. Check the claim

Read incorporation, currency, amount, claim route and any undertaking. Reconcile reimbursement instructions with the credit; a funding arrangement does not replace documentary examination.

Worked Case

Scenario: Is naming a reimbursing bank enough to establish its independent payment undertaking?

Approach: No. Identify whether an undertaking was actually issued and its terms.

Self-Check And Answer

Which document should the claiming bank check before sending a reimbursement claim?

Show Answer

The relevant reimbursement authorization and any undertaking, alongside its own credit instructions.

6. ISP98 — Standby Letters of Credit

ISP98; the individual standby wording

1. Read the standby as an undertaking

Identify the beneficiary, issuer, amount, expiry and required demand documents. Confirm the expressly incorporated rules.

2. Build a demand checklist

Check where and how presentation must occur, the required statement and signatures, drawing limits and amendment history. Distinguish the underlying default from the documents required to claim.

Worked Case

Scenario: A beneficiary alleges default but omits a statement expressly required by the standby. Is the allegation alone sufficient?

Approach: No. Test the presentation against the standby and incorporated rules.

Self-Check And Answer

Can commercial-LC practice be copied into every standby unchanged?

Show Answer

No. Use the standby’s wording and applicable standby rules.

7. URDG 758 — Demand Guarantees

URDG 758; related ISDGP study

1. Separate the instruments

Map applicant, beneficiary, guarantor and any counter-guarantor. A guarantee and counter-guarantee are separate undertakings.

2. Prepare a compliant demand

Identify incorporation, demand conditions, supporting statement, presentation channel, expiry and reduction provisions. Check the actual text before treating a contract dispute as a documentary conclusion.

Worked Case

Scenario: A counter-guarantee exists. Can its beneficiary demand directly under the separate local guarantee merely because both concern the same contract?

Approach: Do not assume interchangeable rights. Identify the beneficiary and claim requirements of each undertaking.

Self-Check And Answer

What should be checked first when selecting a guarantee checklist?

Show Answer

The undertaking’s wording and the rules it expressly incorporates.

8. Electronic Trade — eUCP 2.1, eURC 1.1 and URDTT

eUCP 2.1; eURC 1.1; URDTT 1.0

1. Select the framework

Distinguish electronic presentation under a credit, electronic collection and a fully digital trade transaction. State the applicable rules and version.

2. Plan the presentation

Agree formats, presentation address, access and completion requirements. Check legal recognition of electronic transferable records separately from platform capability.

Worked Case

Scenario: A PDF is emailed to a bank. Does that alone prove a valid electronic presentation?

Approach: No. Check incorporation, agreed presentation requirements and applicable law.

Self-Check And Answer

Does technology capability establish legal recognition in every jurisdiction?

Show Answer

No. Legal recognition requires a separate jurisdiction-specific check.
